Agreement to Terms

These Terms and Conditions (“Terms”) govern your use of the Reserve Batch website (reservebatch.com), your account, and any purchases you make from us. By accessing our website, joining our waitlist, creating an account, or placing an order, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our website or services. Reserve Batch is owned and operated as a sole proprietorship based in Orange County, California. Our contact email is hello@reservebatch.com.

We reserve the right to update these Terms at any time. Continued use of our website or services after an update constitutes your acceptance of the revised Terms.

Cottage Food Permit & Regulatory Disclosure

Reserve Batch operates under a California Class A Cottage Food Permit issued pursuant to California Health & Safety Code §§ 113758113762 (the California Homemade Food Act). Under this permit:

  • Our products are prepared in a private home kitchen that has not been inspected by the California Department of Public Health or any local environmental health agency.
  • We are authorized to sell non-potentially-hazardous cottage food products directly to consumers only — no wholesale or third-party retail.
  • Sales are limited to direct-to-consumer transactions via our website, in-person at permitted events, and direct pickup from our location.
  • All products are labeled in compliance with California cottage food labeling requirements, including the mandatory statement: “Made in a home kitchen that is not inspected by the State or local health department.”

By purchasing from Reserve Batch, you acknowledge that our products are prepared in a home kitchen and accept the conditions of that preparation environment.

Allergen Disclosure & Food Safety

Our cookies are crafted in a home kitchen where the following major food allergens are regularly present. Cross-contact cannot be guaranteed against.

  • Wheat & Gluten — all products contain or are made alongside wheat flour
  • Eggs — present in all cookie recipes
  • Dairy / Milk — butter and dairy products are used in all baking
  • Tree Nuts — walnuts, pecans, macadamia nuts, and other tree nuts are used regularly
  • Peanuts — peanut butter and peanut products are used in rotating flavors
  • Soy — present in some ingredients (chocolate chips, certain mix-ins)

Our kitchen is not allergen-free. If you have a severe food allergy, please do not purchase from us. We cannot accommodate requests to make allergen-free versions of any product.

Product descriptions and ingredient information are provided on our website and on product labels to the best of our ability. However, seasonal and rotating flavors may introduce new ingredients. We encourage all customers to review the current batch menu for up-to-date ingredient information before ordering.

By placing an order, you confirm that you have reviewed our allergen disclosure and accept responsibility for determining whether our products are safe for you or anyone you are purchasing for.

Pre-Order Drop Model

Reserve Batch operates on a limited-time pre-order drop model. We do not maintain a permanent inventory or fulfil standing orders. Each “drop” is a defined ordering window during which a specific menu is made available for purchase.

  • Order windows are time-limited. Once a drop closes, no additional orders can be placed for that batch.
  • Inventory is strictly limited. Items may sell out before a drop window closes. Availability is shown in real time but is not guaranteed. Completing checkout is the only way to secure your order.
  • Reserve members receive early drop access — 2 hours before the public window opens — as a membership benefit.
  • Menus vary by drop. Staple items are available most drops; rotating and seasonal flavors are announced each week and are not guaranteed to repeat.
  • All sales are final. Because our products are perishable and made to order in small batches, we do not accept returns or exchanges once a drop closes and production has begun.

Pickup & Fulfillment

Local Pickup Only

At this time, all orders must be picked up in person. We do not ship products. Shipping perishable cottage food items is not permitted under our current permit and is not a service we offer.

Pickup details — including the location address, date, and available time window — will be provided in your order confirmation email. Pickup locations may be our home address or a designated pop-up event venue.

Pickup Windows

  • You must pick up your order within the designated pickup window communicated in your confirmation. Orders not picked up during that window may be forfeited without refund.
  • If you are unable to pick up during the scheduled window, contact us as early as possible at hello@reservebatch.com and we will do our best to accommodate you. We cannot guarantee alternative arrangements.

Future Local Delivery

We plan to offer local delivery within a 5-mile radius of our Orange County location in a future phase of operations. Delivery availability, scheduling, and any associated fees will be communicated when this service launches. These Terms will be updated accordingly at that time.

Pop-Up Events

We periodically sell at pop-up events, farmers markets, and similar venues. In-person event sales are walk-up only and not subject to the pre-order drop model. Availability at events is limited and sold on a first-come, first-served basis. Some items may be exclusive to events and unavailable online.

Payment & Pricing

Pricing

All prices are listed in U.S. dollars and are inclusive of any applicable California sales tax at the time of checkout. Prices are subject to change between drops. The price shown at checkout is the final price you will be charged.

Payment Processing

Online payments are processed securely by Stripe. We do not store, see, or handle your full card number at any point. By completing a purchase, you agree to Stripe's consumer terms.

In-person purchases at pop-up events may be paid via card reader, cash, or other accepted methods as communicated at the event.

Refunds & Cancellations

  • All sales are final once a drop closes and production has begun. We do not offer refunds or exchanges for completed orders.
  • If we are unable to fulfill your order due to circumstances on our end (e.g., a production issue that affects your specific items), we will issue a full refund or credit at our discretion.
  • If you believe there is a quality issue with your order, contact us within 24 hours of pickup with a description and photo. We handle quality concerns on a case-by-case basis and want to make things right.

Account Usage

Creating an Account

Customers may create an account using a magic link sent to their email address. You do not need to create a password — your email address serves as your identity. An account is not required to browse the site or join the waitlist, but is required to place online orders and participate in our loyalty program.

Account Accuracy

You agree to provide accurate and current information when creating your account and to keep it up to date. This includes your name, email address, and phone number (if provided). Inaccurate information may affect your ability to receive order confirmations, loyalty credits, or pickup communications.

Account Security

Magic link login emails are single-use and expire after a short window. Do not forward or share login links with others. You are responsible for all activity that occurs under your account. If you believe your account has been accessed without your permission, notify us immediately at hello@reservebatch.com.

One Account Per Person

Each customer may maintain one account. Duplicate accounts may be merged or removed at our discretion. Loyalty points and tier status accrue to a single account and cannot be split or transferred.

Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, abuse our loyalty or membership programs, or otherwise act in a manner harmful to Reserve Batch or its customers. You may also request that your account be deleted at any time by contacting us.

Guest purchases at pop-up events do not require an account. However, no loyalty points are awarded for anonymous transactions.

Loyalty Program & Reserve Membership

Loyalty Points

Registered customers earn loyalty points on qualifying purchases. Points are credited after a successful order and are subject to verification. We reserve the right to reverse points awarded in error or resulting from fraudulent activity.

  • Points have no cash value and cannot be transferred, sold, or gifted.
  • Points may be redeemed for free cookies at a rate of 75 points per cookie, in whole increments only.
  • Redeeming points does not affect your loyalty tier standing.
  • Points expire if your account is inactive (no purchase) for 24 consecutive months.

Loyalty Tiers

Tier status (Regular, Devoted, Curator) is calculated based on your rolling 12-month dollar spend. Tiers affect your points multiplier and birthday perks but do not grant any monetary value. We reserve the right to modify tier thresholds, benefits, or the program structure with reasonable notice.

Reserve Membership

Reserve membership is a paid subscription at $10/month, billed automatically through Stripe. By enrolling, you authorize recurring monthly charges until you cancel.

  • Membership may be cancelled at any time through your account or by contacting us. Cancellation takes effect at the end of the current billing period — no prorated refunds are issued for unused portions of a billing cycle.
  • If your membership payment fails, we will make reasonable retry attempts. Continued non-payment may result in membership cancellation and reversion to your spend-based loyalty tier.
  • Reserve membership benefits (early access, 2× points multiplier, enhanced birthday perk) are active only while your subscription is in good standing.
  • We do not offer discounts, trials, or promotional pricing on Reserve membership.

Birthday Perks

Birthday perks are available to customers who have provided their birth month and hold a qualifying loyalty tier. One free cookie perk is applied automatically during your birthday month. Perks cannot be carried over, exchanged for cash, or combined with other free-cookie redemptions.

Email Communications

By providing your email address to Reserve Batch — whether through the waitlist, account creation, or checkout — you consent to receive emails from us as described below. All mailing list subscribers are added via double opt-in: you must click a confirmation link before receiving any marketing or drop-announcement emails.

Types of Email We Send

  • Transactional emails — order confirmations, pickup reminders, magic link logins, membership billing notifications. These are sent as a necessary part of your transaction and cannot be opted out of while your account or order is active.
  • Drop announcements — notifications when a new batch opens for pre-orders. Sent to confirmed waitlist subscribers only.
  • Loyalty & membership notifications — tier changes, grace period warnings, birthday perk activation.

Unsubscribing

Every non-transactional email includes a one-click unsubscribe link in the footer, compliant with CAN-SPAM and RFC 8058. You may also unsubscribe by emailing hello@reservebatch.com with “Unsubscribe” in the subject line. Requests are processed within 10 business days.

Unsubscribing from marketing emails does not affect transactional emails related to an active order, membership, or account.

Intellectual Property

All content on this website — including but not limited to text, branding, logos, photography, product names, and design — is the property of Reserve Batch or its respective creators and is protected by applicable copyright and trademark law.

You may not reproduce, distribute, republish, or create derivative works from any of our content without prior written permission. Personal, non-commercial sharing of our content (e.g., sharing a link or tagging us on social media) is welcome and encouraged.

“Reserve Batch,” the Reserve Batch wordmark, and associated brand elements are proprietary to Reserve Batch. Unauthorized use is prohibited.

Limitation of Liability

Reserve Batch provides its products and services “as is.” To the fullest extent permitted by California law, we disclaim all warranties, express or implied, regarding our products, website, loyalty program, and membership services.

We are not liable for any indirect, incidental, or consequential damages arising from your use of our website, your account, or your purchase — including but not limited to loss of loyalty points due to account deletion, missed pickup windows, or allergic reactions resulting from failure to review our allergen disclosure.

Our total liability to you for any claim arising from a purchase shall not exceed the amount you paid for the specific order giving rise to the claim.

Nothing in these Terms limits our liability for personal injury caused by our negligence, fraud, or any other liability that cannot be limited under California law.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Orange County, California, and you consent to personal jurisdiction in those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our operations, legal requirements, or services offered. When we do, we will revise the “Last updated” date at the top of this page.

For material changes — such as modifications to refund policy, allergen disclosures, or membership terms — we will notify active customers by email at least 14 days before the change takes effect. Continued use of our services after that date constitutes your acceptance of the updated Terms.
